1. About these Terms
These Website Terms of Use (these “Terms”) govern your access to and use of the Mapxus website at mapxus.com and any subdomain (the “Website”). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
These Terms cover the Website only. They do not govern use of the Mapxus indoor mapping and positioning service, the Mapxus SDK or API, or any Mapxus product. Those are governed by a separate Master Services Agreement between Mapxus and the relevant customer.
2. Who we are
The Website is operated by Mapxus Technology Pte. Limited (UEN 202024637M), a private company limited by shares incorporated in Singapore with registered office at 10 Anson Road #11-20, International Plaza, Singapore 079903 (“Mapxus”).
For the Japanese-language Website, the operator is 株式会社マプサス・テクノロジー・ジャパン (Mapxus Technology Japan K.K., 法人番号 4140001118039). For these Terms, references to “Mapxus” include the relevant operator of the Website version you are viewing.
3. Intellectual property
All content on the Website, including text, graphics, logos, images, software, and the “Mapxus” trade mark, is the intellectual property of Mapxus Technology Holding Limited (BVI) or its licensors and is protected by copyright, trade mark, and other applicable laws. You may view and temporarily cache the Website content for personal and non-commercial use only. No other use is permitted without prior written consent.
4. Permitted use
You may:
(a) view, browse, and interact with the Website for informational purposes;
(b) submit inquiries, “Book a Demo” requests, newsletter sign-ups, and similar communications through forms provided on the Website; and
(c) download materials (such as brochures or case studies) that are expressly made available for download.
5. Prohibited use
You shall not:
(a) copy, modify, distribute, sell, rent, or otherwise exploit any content on the Website except as permitted in Section 4;
(b) scrape, crawl, or systematically extract data from the Website, except through mechanisms we make publicly available (such as a sitemap or public API if offered);
(c) reverse engineer, decompile, or attempt to derive the source code of any software available on the Website;
(d) introduce malicious code, launch denial-of-service attacks, or otherwise interfere with the Website’s availability or integrity;
(e) attempt to gain unauthorised access to any part of the Website or its underlying systems;
(f) use the Website for any purpose prohibited by applicable law; or
(g) remove, alter, or obscure any copyright, trade mark, or other proprietary notice.
6. Accuracy of information
The content on the Website is provided for general information purposes only. Mapxus makes reasonable efforts to keep the Website accurate and current, but makes no representation or warranty that the content is complete, accurate, or up to date. Specifications, performance claims, and pricing for Mapxus products are subject to change and are binding only as set out in a written agreement.
7. Third-party links
The Website may contain links to third-party websites. Mapxus has no control over those websites and is not responsible for their content, accuracy, or practices. Your use of any third-party website is at your own risk and subject to that website’s own terms.
8. Privacy
Your use of the Website is subject to the Mapxus Privacy Policy, which describes what Personal Data Mapxus collects and how it is processed. The Privacy Policy is available at mapxus.com/legal/privacy (English version).
9. Disclaimer of warranties
The Website is provided “AS IS” and “AS AVAILABLE”. To the maximum extent permitted by applicable law, Mapxus disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Mapxus does not warrant that the Website will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by applicable law, Mapxus shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or relating to your use of the Website. Mapxus’s total aggregate liability for any claim arising out of or relating to the Website shall not exceed SGD 100 (or the equivalent in another currency).
This Section 10 does not limit any liability that cannot be limited under applicable law, and does not apply to any Mapxus product or service, which is governed by a separate Master Services Agreement.
11. Changes to these Terms
Mapxus may update these Terms from time to time. The “Last updated” date above indicates when this version took effect. Your continued use of the Website after any update constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by, and shall be construed in accordance with, the laws of the Republic of Singapore. Save that, for Users accessing the Japanese-language Website operated by Mapxus Technology Japan K.K., the laws of Japan shall apply. Any dispute shall be subject to the exclusive jurisdiction of the courts of the respective jurisdiction.
Nothing in these Terms prevents a consumer from exercising mandatory consumer-protection rights in their country of residence.
13. General
Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
No waiver. A failure or delay in enforcing any right is not a waiver.
Entire agreement. These Terms are the complete agreement between you and Mapxus regarding the Website.
Language. The authoritative version of these Terms is the English version. Translations are for convenience; in case of conflict the English version prevails.
